Privacy Statement of QUADRAGON Management LLC (https://www.quadragon.ch)

Introductory overview

Thank you very much for your interest in our company. Use of the QUADRAGON Management LLC website (hereinafter synonymously used: https://www.quadragon.ch) is generally possible without any indication of personal data. However, if a data subject wishes to make use of special services via our website, it is generally necessary to process personal data. If the processing of personal data is necessary and there is no legal basis for such processing, we generally obtain the consent of the person concerned.

The processing of personal data, for example the name, address or e-mail address of a person concerned, is always carried out in accordance with the European Basic Data Protection Regulation and in accordance with the country-specific data protection regulations applicable to QUADRAGON Management LLC. By means of this privacy statement, our company wishes to inform the public about the nature, scope and purpose of the personal data collected, used and processed by us. Furthermore, data subjects are informed of their rights by means of this data protection declaration.

As the data processor, QUADRAGON Management GmbH has implemented numerous technical and organisational measures to ensure the most complete possible protection of the personal data processed via this website. Nevertheless, Internet-based data transmissions can in principle have security gaps, so that absolute protection cannot be guaranteed. For this reason, each person concerned is free to transmit personal data to us by alternative means, for example by letter.

Since we believe that the following information on data protection is very important, you should take the time to read our privacy statement carefully, as it forms an integral part of the legal relationship between you and QUADRAGON Management LLC.

1. Definitions

QUADRAGON Management LLC’s Privacy Policy is based on the terms used by the European Directive and Regulation Makers in the adoption of the European Data Protection Basic Regulation (DS-GVO). Our privacy statement should be easy to read and understand for the public as well as for our customers and business partners. In order to guarantee this, we would like to explain the terms used in advance.

We use the following terms in this privacy statement, among others:

(a) Personal data

Personal data is any information relating to an identified or identifiable natural person (hereinafter “data subject”). A natural person shall be considered identifiable if he can be identified directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an on-line identifier or one or more specific characteristics expressing the physical, physiological, genetic, psychological, economic, cultural or social identity of that natural person.

(b) Data subject

Data subject means any identified or identifiable natural person whose personal data are processed by the controller.

(c) Processing

Processing shall mean any operation or set of operations which is performed on personal data, such as collection, recording, organisation, arrangement, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or association, qualification, erasure or destruction, whether or not by automatic means.

(d) Limitation of processing

Limitation of processing is the marking of stored personal data with the aim of limiting their future processing.

e) Profiling

Profiling means any automated processing of personal data consisting of the use of such personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects relating to the work performance, economic situation, health, personal preferences, interests, reliability, behaviour, whereabouts or movements of that natural person.

f) Pseudonymisation

Pseudonymisation means the processing of personal data in such a way that the personal data can no longer be attributed to a specific data subject without additional information, provided that such additional information is kept separately and is subject to technical and organisational measures designed to ensure that the personal data are not attributed to an identified or identifiable natural person.

(g) Controller or data controller

The controller or data controller is the natural or legal person, public authority, agency or other body which alone or jointly with others determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are laid down by Union law or by the law of the Member States or by Swiss law, the controller may be designated in accordance with Union law or with the law of the Member States or with Swiss law, as the case may be.

(h) Processors under contract

Processor under contract is a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.

i) Recepient

The recipient is a natural or legal person, public authority, agency or other body to whom personal data are disclosed, whether or not that person is a third party. However, authorities which may receive personal data in the context of a specific investigation mandate under Union law or the law of the Member States or Swiss law shall not be considered as recipients.

(j) Third parties

Third party means any natural or legal person, public authority, agency or body other than the data subject, the controller, the processor under contract and the persons who, under the direct authority of the controller or processor under contract, are authorized to process the personal data.

(k) Consent

Consent shall mean any voluntary, informed and unambiguous expression by the data subject of his or her will in the particular case, in the form of a statement or other unequivocal confirmatory act, indicating that he or she consents to the processing of his or her personal data.

The person responsible within the meaning of the European Data Protection Basic Regulation, other data protection laws applicable in the member states of the European Union or Swiss data protection law and other provisions of a data protection nature is:

3. information collected by us

We collect information in order to provide you with even better services in the future and to improve or simplify your interaction with https://www.quadragon.ch. We collect information in two ways:

a) Data that you provide directly to us

In order to use some services of https://www.quadragon.ch, e.g. to order newsletters, you must provide personal data such as your name, e-mail address, etc. You also provide us with data directly as soon as you create your own user content. This means, for example, if you upload your own contributions, post comments, participate in ratings, etc.

  • Local storage: In order to shorten your loading times, we collect and store information (including personal data) locally on your device using mechanisms such as your browser’s web memory (including HTML 5) and application data caches.
4. Specifics of cookies

Many websites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. Through the use of cookies, QUADRAGON Management GmbH can provide users of our culture and management network with more user-friendly services that would not be possible without the setting of cookies.

By means of a cookie, the information and offers on our website can be optimised in the interests of the user. Cookies enable us, as already mentioned, to recognize the users of our website. The purpose of this recognition is to make it easier for users to use our website. For example, the user of a website that uses cookies does not have to re-enter his access data each time he visits the website because this is taken over by the website and the cookie stored on the user’s computer system. Another example is the cookie of a shopping basket in the online shop. The online shop remembers the items that a customer has placed in the virtual shopping basket via a cookie.

The person concerned can prevent the setting of cookies by our website at any time by means of an appropriate setting of the Internet browser used and thus permanently object to the setting of cookies. Furthermore, cookies that have already been set can be deleted at any time via an Internet browser or other software programs. This is possible in all common Internet browsers. If the person concerned deactivates the setting of cookies in the Internet browser used, not all functions of our website may be fully usable under certain circumstances.

5. Specifics for the collection of general data and information

The QUADRAGON Management LLC website collects a series of general data and information each time the website is called up by a person concerned or an automated system. This general data and information is stored in the log files of the server. The (1) browser types and versions used can be recorded, (2) the operating system used by the accessing system, (3) the website from which an accessing system accesses our website (so-called referrer), (4) the sub-sites which are accessed via an accessing system on our website, (5) the date and time of an access to the website, (6) an internet protocol address (IP address), (7) the internet service provider of the accessing system and (8) other similar data and information which serve to avert danger in the event of attacks on our information technology systems.

When using this general data and information, QUADRAGON Management LLC does not draw any conclusions about the person concerned. This information is needed (1) to correctly deliver the content of our website, (2) to optimize the content of our website and advertising for it, (3) to ensure the long-term functionality of our information technology systems and the technology of our website, and (4) to provide law enforcement authorities with the information necessary for law enforcement in the event of a cyber attack.

This anonymously collected data and information is therefore evaluated by QUADRAGON Management LLC both statistically and with the aim of increasing data protection and data security in our company in order to ultimately ensure an optimum level of protection for the personal data processed by us. The anonymous data of the server log files are stored separately from all personal data provided by the person concerned.

6. Specifics for registration on our website

The data subject shall have the possibility to register on the website of the controller, indicating personal data. The personal data transmitted to the data controller is determined by the respective input mask used for registration. The personal data entered by the data subject shall be collected and stored exclusively for internal use by the data controller and for its own purposes. The controller may arrange for the data to be disclosed to one or more processors, such as a parcel service provider, who will also use the personal data exclusively for internal purposes attributable to the controller.

By registering on the website of the data controller, the IP address assigned to the data subject by the Internet service provider (ISP), the date and time of registration are also stored. The storage of these data takes place against the background that only so the abuse of our services can be prevented, and these data make if necessary possible to clear up committed crimes. In this respect, the storage of this data is necessary to safeguard the data controller. This data will not be passed on to third parties unless there is a legal obligation to do so or unless the data is used for criminal prosecution.

The registration of the data subject by voluntarily providing personal data serves the purpose of the data controller to offer the data subject contents or services which, due to the nature of the matter, can only be offered to registered users. Registered persons are free to modify the personal data provided during registration at any time or to have them completely deleted from the database of the data controller.

The data controller shall provide any data subject at any time upon request with information as to which personal data relating to the data subject are stored. Furthermore, the data controller shall correct or delete personal data at the request or notice of the data subject, provided that this does not conflict with any statutory storage obligations. A data protection officer named in this privacy statement and the entire staff of the controller shall be available to the data subject as contact persons in this context.

7. Specifics for newsletter subscription

On the QUADRAGON Management LLC website, users are given the opportunity to subscribe to our company newsletter. Which personal data is transferred to the person responsible for processing when ordering the newsletter results from the input mask used for this purpose.

QUADRAGON Management LLC informs its customers and business partners at regular intervals by means of a newsletter about news and offers about our company. The newsletter of our company can only be received by the person concerned if (1) the person concerned has a valid e-mail address and (2) the person concerned registers to receive the newsletter. For legal reasons, a confirmation e-mail in the double opt-in procedure will be sent to the e-mail address entered for the first time by a person concerned for the purpose of sending the newsletter. This confirmation e-mail is used to check whether the owner of the e-mail address as the person concerned has authorised receipt of the newsletter.

When registering for the newsletter, we also store the IP address assigned by the Internet Service Provider (ISP) to the computer system used by the person concerned at the time of registration as well as the date and time of registration. The collection of this data is necessary in order to be able to trace the (possible) misuse of the e-mail address of a data subject at a later date and therefore serves to legally safeguard the data controller.

The personal data collected in the course of registering for the newsletter will be used exclusively to send our newsletter. Furthermore, subscribers to the newsletter could be informed by e-mail if this is necessary for the operation of the newsletter service or registration in this respect, as might be the case in the event of changes to the newsletter offer or changes to the technical conditions.

The personal data collected as part of the newsletter service will not be passed on to third parties.

The subscription to our newsletter can be cancelled by the person concerned at any time. The consent to the storage of personal data, which the person concerned has given us for the newsletter mailing, can be revoked at any time. For the purpose of revoking your consent, you will find a corresponding link in every newsletter. It is also possible at any time to unsubscribe from the newsletter dispatch directly on the website of the data controller or to inform the data controller of this in any other way.

8. Newsletter tracking specifics

The QUADRAGON Management LLC newsletter contains a so-called trecking pixels. A trecking pixel is a thumbnail image embedded in newsletter emails that are sent in HTML format to enable log file recording and analysis. This allows a statistical evaluation of the success or failure of online marketing campaigns to be carried out. Using the embedded trecking pixel, QUADRAGON Management LLC can recognize whether and when an e-mail was opened by an affected person and which links contained in the e-mail were accessed by the affected person.

Such personal data collected via the trecking pixels contained in the newsletters will be stored and evaluated by the data controller in order to optimise the newsletter dispatch and to adapt the content of future newsletters even better to the interests of the person concerned. This personal data will not be passed on to third parties. Affected persons are entitled at any time to revoke the relevant separate declaration of consent submitted via the double opt-in procedure. After revocation, this personal data will be deleted by the data controller. QUADRAGON Management LLC automatically interprets a unsubscription from the receipt of the newsletter as a legally binding revocation.

9. Specifics about the possibility of contact via the website

The website of QUADRAGON Management LLC contains, due to legal regulations, information that enables quick electronic contact with our company and direct communication with us, which also includes a general address of the so-called electronic mail (e-mail address).

If a data subject contacts the controller by e-mail or via a contact form, the personal data transmitted by the data subject shall be automatically stored. Such personal data transmitted voluntarily by a data subject to the controller are stored for the purposes of processing or contacting the data subject. This personal data will not be passed on to third parties.

10. Specifics on interaction with contributions

QUADRAGON Management LLC offers users the opportunity to post individual comments, evaluations, etc. on our website. If a data subject leaves such an evaluation or comment, information about the time of content entry and the identity of the data subject will be stored and possibly published in addition to the content left by the data subject. Furthermore, the IP address assigned by the Internet Service Provider (ISP) to the person concerned is logged. This IP address is stored for security reasons and in the event that the person concerned violates the rights of third parties or posts illegal content through his or her rating or comment.

The storage of these personal data takes place in the own interest of the data controller, so that in the event of a violation of the law, the data controller could exculpate himself. This collected personal data will not be passed on to third parties unless such a passing on is prescribed by law or serves the legal defence of the controller.

11. Routine deletion and blocking of personal data

The data controller shall process and store the personal data of the data subject only for the period of time necessary to achieve the storage purpose or if provided for by Swiss law or European directives or regulations or by another legislator in laws or regulations to which the data controller is subject.

If the storage purpose ceases to apply or if a storage period prescribed by Swiss law or the European Directive and Ordinance or another competent legislator expires, the personal data shall be blocked or deleted routinely and in accordance with the statutory provisions.

12. Further use of the information collected by us

In addition to the above specifics, we use the data collected within the framework of our services to provide, maintain, protect and improve our services, to develop new services and to protect https://www.quadragon.ch and our users as a whole.

Information may therefore be used to assist you after you have logged in, to access your information more efficiently, and to remind you of certain information so that you do not have to re-enter it when you visit or next use our services. We may also use the information we collect to provide you with personalized content and information, including online advertisements and other forms of marketing.

https://www.quadragon.ch or other users may conduct contests, special offers, or other events or activities on a specifically offered service that may be of interest to you based on your personal information. Finally, we use aggregated and non-personalized analytic metrics to monitor our server traffic, such as the total number of visitors, page views, target URLs, or demographic patterns, and use them to diagnose and troubleshoot technical issues.

If you contact us, we will record your communication to help you solve any problems you may have. Notices regarding the use of our services, including notices of upcoming changes or improvements, will be sent to you at the e-mail address provided by us.

13. Information selection possibilities and account closure

The needs and concerns with regard to one’s own data protection are different for each person. Some people want a lot of data protection, others are indifferent to it. As we take data protection very seriously, we would like to collect as little personal data as possible from you. As a service company, however, we cannot do without data completely. However, we try to collect only as much personal information from you as is actually necessary to ensure the smooth and enjoyable operation of https://www.quadragon.ch for you and other users.

You can therefore change your account information at any time by updating or (partially) deactivating the profile settings of your user account under “Edit profile”. You can also set your browser to block all cookies. Please keep in mind, however, that some of our services may then not (no longer) function properly.

To unsubscribe from our general e-mail communications, such as the newsletter, simply click on the “unsubscribe” link at the end of each newsletter message. As already mentioned above, however, technical communication regarding our services cannot be dispensed with.

As long as you are a registered user of https://www.quadragon.ch in any form, your data will remain in the latest form updated by you. However, we reserve the express right to irrevocably close and delete user accounts that have not been actively used for a longer period of time, i.e. usually more than 24 or more months.

You also have the right to close or delete your user account at any time. The corresponding “Delete account” button can be found in the profile settings in your user profile under “Change profile”. When a user account is closed or deleted, all personal information is usually irrevocably deleted. These can usually not be restored!

We therefore assume no liability whatsoever for the loss of the information stored in your profile or linked to it in any form – regardless of whether the closure/deletion was carried out by yourself or https://www.quadragon.ch. Excluded from deletion are all data collected in a non-personalized or aggregated form and information that may exist independently of your user account (posts, comments, ratings, etc.).

14. Rights of the data subject

a) Right to confirmation

Each data subject shall have the right, granted by Swiss law or European directives and regulations, to obtain from the controller confirmation as to whether personal data relating to him or her will be processed. If a data subject wishes to exercise this right of confirmation, he or she can contact our data protection officer or another employee of the data controller at any time.

b) Right of disclosure

Any person affected by the processing of personal data has the right, granted by Swiss law or European directives and regulations, to obtain at any time, free of charge, from the data controller, information about the personal data stored about that person and a copy of such information. In addition, the Swiss legislator and the European directive and ordinance makers have granted the data subject information on the following information:

– the processing purposes

– the categories of personal data processed

– the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organisations

– if possible, the planned duration for which the personal data will be stored or, if that is not possible, the criteria for determining that duration

– the existence of a right to the rectification or erasure of personal data concerning him or her or to the limitation of the processing carried out by the controller or of a right to object to such processing

– the existence of a right of appeal to a supervisory authority

– if the personal data are not collected from the data subject: All available information on the origin of the data

– the existence of automated decision-making, including profiling, in accordance with Article 22 (1) and (4) of the DS-GVO (or the corresponding Swiss legal provision) and – at least in these cases – meaningful information on the logic involved and the scope and intended effects of such processing for the data subject

The data subject also has the right to know whether personal data have been transferred to a third country or to an international organisation.. If this is the case, the data subject shall also have the right to obtain information on the appropriate safeguards in connection with the transfer.

If a data subject wishes to exercise this right to information, he or she can contact our data protection officer or another employee of the data controller at any time.

(c) Right to rectification

Any person concerned by the processing of personal data has the right, granted by the Swiss legislator or by the European directive and regulation authorities, to request the immediate rectification of any inaccurate personal data concerning him or her. Furthermore, the data subject shall have the right, having regard to the purposes of the processing, to request the completion of incomplete personal data, including by means of a supplementary statement.

If a data subject wishes to exercise this right of rectification, he or she can contact our data protection officer or another employee of the data controller at any time.

d) Right to cancellation (right to be forgotten)

Any person data subject to the processing of personal data has the right, granted by Swiss law or European directives and regulations, to require the data controller to delete the personal data relating to him or her immediately, if one of the following reasons applies and if the processing is not necessary:

– The personal data have been collected for such purposes or processed in any other way for which they are no longer necessary.

– The data subject shall revoke his or her consent to which the processing pursuant to Art. 6 para. 1(a) DS-GVO or Art. 9 para. 2(a) DS-GVO (or the corresponding Swiss legal provisions), and there is no other legal basis for the processing.ng.

– In accordance with Art. 21 para. 1 DS-GVO (or the corresponding Swiss legal provision) against the processing, and there are no overriding legitimate reasons for the processing, or the data subject submits an objection in accordance with Art. 21 para. 2 DS-GVO (or the corresponding Swiss legal provision) against the processing.

– Personal data has been processed unlawfully.

– The deletion of personal data is necessary to fulfil a legal obligation under Swiss or Union law or the law of the Member States to which the person responsible is subject.

– The personal data have been processed in relation to information society services offered pursuant to Art. 8 para. 1 DS-GVO (or the corresponding Swiss legal provision).

If one of the above reasons applies and a person concerned wishes to have personal data stored at QUADRAGON Management LLC deleted, he or she can contact our data protection officer or another employee of the data controller at any time. The data protection officer of QUADRAGON Management LLC or another employee will ensure that the request for deletion is complied with immediately.

If the personal data has been made public by QUADRAGON Management LLC and our company is responsible pursuant to Art. 17 para. 1 DS-GVO (or the corresponding Swiss statutory provision) to delete personal data, QUADRAGON Management LLC, taking into account the available technology and implementation costs, shall take appropriate measures, also of a technical nature, to inform other persons responsible for data processing who process the published personal data that the data subject has requested these other persons responsible for data processing to delete all links to this personal data or copies or replications of this personal data, insofar as the processing is not necessary. The data protection officer of QUADRAGON Management LLC or another employee will take the necessary steps in individual cases.

(e) Right to limitation of processing

Any person concerned by the processing of personal data has the right, granted by Swiss law or European directives and regulations, to request the controller to restrict the processing if one of the following conditions is met:

– The accuracy of the personal data is contested by the data subject for a period of time which allows the data controller to verify the accuracy of the personal data.

– The processing is unlawful, the data subject refuses the deletion of the personal data and demands instead the restriction of the use of the personal data.

– The controller no longer needs the personal data for the purposes of processing, but the data subject needs them for the assertion, exercise or defence of legal claims.

– The data subject has lodged an appeal against the processing pursuant to Art. 21 para. 1 DS-GVO (or the corresponding Swiss legal provision) and it is not yet clear whether the legitimate reasons of the person responsible outweigh those of the data subject.

If one of the above conditions is met and a data subject wishes to request the restriction of personal data stored at QUADRAGON Management LLC, he or she can contact our data protection officer or another employee of the data controller at any time. The data protection officer of QUADRAGON Management LLC or another employee will initiate the restriction of processing.

f) Right to data transferability

Any person data subject to the processing of personal data has the right, granted by Swiss law or European directives and regulations, to obtain personal data concerning him or her, provided by the data subject to a controller, in a structured, common and machine-readable format. It also has the right to communicate this data to another data controller without being hindered by the data controller to whom the personal data was provided, provided that the processing is based on the consent pursuant to Art. 6 para. 1(a) DS-GVO or Art. 9 para. 2 (a) DS-GVO (or the corresponding Swiss legal provisions) or on a contract in accordance with Art. 6 1 (b) DS-GVO (or the corresponding Swiss legal provision) and the processing is carried out by automated means, unless the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.

Furthermore, in exercising his or her right to data transfer, the data subject shall, in accordance with Art. 20 para. 1 DS-GVO (or the corresponding Swiss statutory provision) the right to obtain that the personal data be transferred directly from one responsible person to another responsible person, insofar as this is technically feasible and insofar as this does not impair the rights and freedoms of other persons.

In order to assert the right to data transferability, the person concerned can contact the data protection officer appointed by QUADRAGON Management LLC or another employee at any time.

(g) Right of appeal

Any person concerned by the processing of personal data has the right granted by Swiss law or European directives and regulations to oppose at any time, for reasons connected with his particular situation, the processing of personal data concerning him by virtue of Art. 6 para. 1 (e) or (f) DS-GVO (or the corresponding Swiss legal provision). This also applies to profiling based on these provisions.

QUADRAGON Management LLC will no longer process personal data in the event of opposition, unless we can prove compelling grounds for processing worthy of protection which outweigh the interests, rights and freedoms of the data subject, or the processing serves to assert, exercise or defend legal claims.

If QUADRAGON Management LLC processes personal data in order to conduct direct advertising, the person concerned has the right to object at any time to the processing of personal data for the purpose of such advertising. This also applies to profiling in so far as it is related to such direct marketing. If the person concerned objects to QUADRAGON Management LLC processing the data for direct marketing purposes, QUADRAGON Management LLC will no longer process the personal data for these purposes.

In addition, the data subject has the right, for reasons arising from his/her particular situation, to oppose the processing of personal data concerning him/her by QUADRAGON Management LLC for scientific or historical research purposes or for statistical purposes in accordance with Art. 89 para. 1 DS-GVO (or the corresponding Swiss statutory provision) to lodge an objection, unless such processing is necessary for the performance of a task in the public interest.

h) Automated decisions in individual cases including profiling

If the decision (1) is necessary for the conclusion or performance of a contract between the data subject and the responsible person or (2) is made with the express consent of the data subject, QUADRAGON Management LLC shall take appropriate measures to safeguard the rights and freedoms as well as the legitimate interests of the data subject, including at least the right to obtain the intervention of a person on the part of the responsible person, to state his or her own position and to challenge the decision.

If the data subject wishes to exercise rights relating to automated decisions, he or she may at any time contact our data protection officer or another employee of the data controller for this purpose.

i) Right to revoke consent under data protection law

Every person affected by the processing of personal data has the right at any time to revoke his/her consent to the processing of personal data as granted by Swiss law or the European Directive and Ordinance.

15. Data protection for applications and in the application procedure

The data controller collects and processes the personal data of applicants for the purpose of processing the application procedure. Processing may also be carried out electronically. This shall in particular be the case where an applicant submits the relevant application documents to the controller by electronic means, for example by e-mail or via a web form on the website.

If the data controller concludes an employment or cooperation agreement with an applicant, the transferred data will be stored for the purpose of processing the employment or cooperation relationship in compliance with the statutory provisions.

Introductory overview

Not only do we make our website and services available to the public at https://www.quadragon.ch, but we also want to offer our visitors and users a safe and contemporary user experience. In order to guarantee this, we use our proprietary IT framework as well as other IT and web applications (applications) that enable interaction with popular third-party applications. QUADRAGON Management LLC therefore relies on the integration of various third-party applications that make our online presence safer, faster, more networked and better accessible for social media interactions.

Many of the applications we use do not require any user data, but some require certain personal information to function. In the following we therefore list those applications which we use on the one hand and which require or process user data on the other. We briefly introduce the individual applications, explain how they work and how they use data. Finally, we also show how our visitors and users can protect themselves from data access to these applications and how they can object to the corresponding use of data. You will find further information and tips on data protection and the privacy setup of your browser as well as on further privacy safeguarding on the Internet.

A. Privacy policy for the use of Google Analytics (with anonymization function)

We have integrated the Google Analytics component (with anonymization function) on our website. Google Analytics is a web analytics service. The purpose of the Google Analytics component is to analyse the flow of visitors to our website. Google uses the collected data and information, among other things, to evaluate the use of our website, to compile online reports for us, which show the activities on our web pages, and to provide further services in connection with the use of our website.

Google Analytics places a cookie on the information technology system of the person concerned. What cookies are is explained in detail in our Privacy Statement. By setting the cookie, Google is able to analyse the use of our website. Each time one of the individual pages of our website on which a Google Analytics component has been integrated is accessed, the Internet browser on the information technology system of the person concerned is automatically prompted by the respective Google Analytics component to transmit data to Google for the purpose of online analysis. As part of this technical process, Google obtains knowledge of personal data, such as the IP address of the person concerned, which Google uses, among other things, to track the origin of visitors and clicks and subsequently to enable commission statements.

The cookie is used to store personal information, such as the access time, the location from which an access originated and the frequency of visits to our website by the person concerned. Each time you visit our web pages, this personal data, including the IP address of the Internet connection used by the person concerned, is transmitted to Google in the United States of America. This personal data is stored by Google in the United States of America. Please note: Google may disclose personal information collected through this technical process to third parties.

The person concerned can prevent the setting of cookies by our website, as described in the data protection declaration, at any time by means of an appropriate setting of the Internet browser used and thus permanently object to the setting of cookies. Such a setting of the Internet browser used would also prevent Google from setting a cookie on the information technology system of the person concerned. In addition, a cookie already set by Google Analytics can be deleted at any time via the Internet browser or other software programs.

Furthermore, it is possible for the person concerned to object to and prevent the collection of data generated by Google Analytics and related to the use of this website as well as the processing of this data by Google. For this purpose, the person concerned must download and install a browser add-on (to be found under Google tools). This browser add-on tells Google Analytics via JavaScript that no data and information about visits to websites may be transmitted to Google Analytics. The installation of the browser add-on is considered by Google as an objection. If the data subject’s information technology system is later deleted, formatted or reinstalled, the data subject must reinstall the browser add-on in order to deactivate Google Analytics. If the browser add-on is uninstalled or deactivated by the person concerned or by another person within his/her sphere of control, the browser add-on can be reinstalled or reactivated.

B. Privacy Policy on the Use and Usage of YouTube

We have integrated components from YouTube on our website. YouTube is an Internet video portal that allows video publishers to post video clips and other users to view, rate and comment on them free of charge. YouTube allows the publication of all types of videos, which is why complete film and television programmes as well as music videos, trailers or videos made by users themselves can be accessed via the Internet portal.

The operating company of YouTube is YouTube, LLC, 901 Cherry Ave, San Bruno, CA 94066, USA. YouTube, LLC is a subsidiary of Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.

Each time a YouTube component (YouTube video) has been integrated on one of the individual pages of our website, the Internet browser on the information technology system of the person concerned is automatically prompted by the respective YouTube component to download a representation of the corresponding YouTube component from YouTube. More information about YouTube can be found on its website. As part of this technical process, YouTube and Google gain knowledge of which specific subpage of our website is visited by the person concerned.

If the person concerned is logged into YouTube at the same time, YouTube recognizes which specific subpage of our website the person concerned is visiting by calling up a subpage containing a YouTube video. This information is collected by YouTube and Google and assigned to the respective YouTube account of the person concerned.

YouTube and Google will receive information through the YouTube component that the individual concerned has visited our website whenever that individual is logged into YouTube at the same time as accessing our website, whether or not that individual clicks on a YouTube video. If such transmission of this information to YouTube and Google is not intended by the data subject, the data subject may prevent the transmission by logging out of his/her YouTube account before accessing our website.

The data protection regulations published on YouTube provide information about the collection, processing and use of personal data by YouTube and Google.

C. Privacy policy for PayPal as payment method

We have integrated components from PayPal on our website. PayPal is an online payment service provider. Payments are processed via so-called PayPal accounts, which are virtual private or business accounts. In addition, PayPal offers the option of processing virtual payments via credit cards if a user does not have a PayPal account. A PayPal account is managed via an e-mail address, which is why there is no classic account number. PayPal makes it possible to initiate online payments to third parties or to receive payments. PayPal also acts as a trustee and offers buyer protection services.

If the person concerned selects “PayPal” as a payment option during a chargeable order process, the data of the person concerned is automatically transferred to PayPal. By selecting this payment option, the data subject consents to the transmission of personal data necessary for the processing of the payment.

The personal data transmitted to PayPal is usually first name, surname, address, email address, IP address, telephone number, mobile phone number or other data necessary for payment processing. Personal data related to the respective order are also necessary for the processing of the purchase contract.

The purpose of data transmission is to process payments and prevent fraud. We will transmit personal data to PayPal in particular if there is a legitimate interest in their transmission. Personal data exchanged between PayPal and the data controller may be transferred by PayPal to credit reference agencies. The purpose of this transmission is to check identity and creditworthiness.

PayPal may share the personal information with affiliated companies and service providers or subcontractors to the extent necessary to fulfill its contractual obligations or to process the information on behalf of PayPal.
